City Awaits Decision in Light Rail Shoreline Permit Litigation

Mar 10, 2017 - In mid-February, the Mercer Island City Council voted to pursue legal action against Sound Transit and the Washington State Department of Transportation (WSDOT) in efforts to ensure that loss-of-mobility mitigation was satisfactorily addressed prior to the closure of the I-90 center roadway.
Today, in King County Superior Court, Judge Beth M. Andrus heard an hour of oral arguments from the City and Sound Transit, related to the Cityís suspension of Sound Transitís Shoreline Substantial Development Permit (SSDP) that the City originally approved last summer, prior to receiving an August 5, 2016, letter from the Federal Highway Administration (FHWA) stating that MI SOV traffic would no longer be permitted access to the R8A lanes on outer roadway and the corresponding ramps.
The Cityís position at todayís hearing was that Sound Transit should take up suspension of the SSDP with the Shorelines Hearings Board. By contrast, Sound Transitís position at the hearing was that the Judge should lift the suspension.
Following the hearing, Judge Andrus committed to rendering her decision by the end of business on Monday, March 13.
